HostUrge.com's Terms of Service policy ("TOS") is provided to give our customers & users a clear understanding of what HostUrge.com expects of them while using our services. All users of HostUrge.com's Internet services: those who access some of our Services but do not have direct accounts with us, as well as those who pay a service fee to subscribe to our Services, must comply with this TOS (Terms of Service).

Use of HostUrge.com Service constitutes acceptance and agreement to HostUrge.com's TOS (Terms of Service)

Terms of Service (TOS)
If an internet account is used to violate the Terms of Service, we reserve the right to terminate the service without notice. Client understands that changes to the TOS by HostUrge shall not be grounds for early contract termination or non-payment.

The following constitutes violations of this TOS:

Illegal Use: HostUrge services may not be used for illegal purposes, or in support of illegal activities. HostUrge reserves the right to cooperate with legal authorities and/or injured third parties in the investigation of any suspected crime or civil wrongdoing.

Harm to minors: Use of the HostUrge service to harm, or attempt to harm, minors in any way, including, but not limited to child pornography.

Threats: Use of the HostUrge service to transmit any material (by email, uploading, posting or otherwise) that threatens or encourages bodily harm or destruction of property.

Harassment: Use of the HostUrge service to transmit any material (by email, uploading, posting or otherwise) that harasses another.

Fraudulent activity: Use of the HostUrge service to make a fraudulent offer to buy or sell products, items, or services or to advance any type of financial scam such as pyramid schemes, ponzi schemes, and chain letters.

Forgery or impersonation: Adding, removing or modifying identifying network header information in an effort to deceive or mislead is prohibited. The use of anonymous remailers or nicknames does not constitute impersonation.

Unsolicited commercial email / Unsolicited bulk email (SPAM): Use of the HostUrge service to transmit any unsolicited commercial or unsolicited bulk email is expressly prohibited. Violations of this type will result in immediate termination of the offending HostUrge account.

Content: Infringement of copyright, patent, trademark, trade secret, or intellectual property right. Distribution and/or posting of copyrighted or the aforementioned infringements will not be tolerated. This includes warez, roms, mp3's, mpegs, or anything else that might violate one or more of these laws.

Security: Game servers are strictly not allowed to be ran of any account. Due to the high level of stress this puts on the system, you will need to purchase a semi-dedicated or dedicated server for this.

Mirror sites and/or mirror files are not allowed on the server.

HostUrge accounts operate on shared resources. Excessive use or abuse of these shared network resources may have a negative impact on all other customers, Misuse of network resources in a manner which impairs network performance is prohibited by this policy and may result in termination or suspension of your account.

Sites that are specifically designed to offer free hosting or sites that for other reasons offer free hosting for users that are not affiliated with the company leasing space from HostUrge is prohibited unless a prior agreement is made with HostUrge. This agreement must contain a contract between HostUrge's client, and the client's client. This contract will insure they have proper identification to prevent fraudulent use.

Customers are forbidden to resell the accounts without a prior agreement from HostUrge,

Server Abuse: any attempts to cause harm to a HostUrge server or customer are strictly prohibited.

IRC and server processing:
We currently do not allow IRC or IRC bots to be operated on our servers.
We currently do not allow eggdrops to operate on our servers.
We currently do not allow BNC to operate on our servers.

Responsibility: You are responsible for any misuse of your account, even if the inappropriate activity was committed by another user under your account, friend, family member, guest or employee. Therefore you must take steps to ensure that other do not gain unauthorized access to another network or server.

Site BackUps: HostUrge makes daily backups of all accounts. It is the clients responsibility to keep current local copies of their entire sites. In the unfortunate event that a server fails and the client information is lost, HostUrge will not be held liable in anyway for the loss. Further to this, HostUrge will make all attempts to re-establish any lost information as a matter of urgency in good faith.

Refusal of Service:
We reserve the right to refuse, cancel or suspend service at our sole discretion. All sub-networks, distributive hosting sites and dedicated servers of HostUrge must adhere to the above Terms of Service. Failure to follow any term or condition will be grounds for immediate account deactivation. HostUrge reserves the right to deny a refund of any monies paid thus far if these policies are broken.

Revisions to this Terms of Service:
HostUrge reserves the right to revise, amend, or modify this TOS (Terms of Service) and our other policies and agreements at any time in any manner.
